White Couple Sues Fertility Clinic After the Wife Gives Birth to a Black Baby

Nationwide — A couple from Orlando, Florida, is suing a fertility clinic after a DNA test showed their newborn baby is not genetically related to them. They claim a mix-up at the clinic led to the implantation of an embryo that wasn’t theirs.

John and Jane Doe, whose names are used in court to protect their privacy, filed an emergency lawsuit against IVF Life, Inc., also known as Fertility Center of Orlando, and Dr. Milton McNichol. The couple says they created three embryos using their own eggs and sperm, and one was implanted in Jane Doe in March 2025.

Their daughter, Baby Doe, was born full-term on December 11, 2025. According to ABC 7 Chicago, concerns arose when the baby displayed physical traits that did not match either parent. Genetic testing later confirmed that the child has no biological connection to John or Jane Doe.

Although the Does have formed a deep emotional bond with Baby Doe, they argue she belongs legally and morally with her biological parents. They also fear that someone else may currently be carrying or raising one of their embryos.

On January 5, 2026, the couple asked the clinic to help identify the child’s biological parents and locate their remaining embryos. The clinic did not provide a meaningful response, prompting the emergency lawsuit. The couple is requesting court action to notify all patients with stored embryos, provide free genetic testing for children born through the clinic in the last five years, and disclose any parentage errors.

The Fertility Center of Orlando said it is cooperating with ongoing investigations. The clinic emphasized that it is working with all parties to determine how the error happened and is focused on transparency and the well-being of the child and parents.
