Dad Gets Only One Year in Jail After Pleading Guilty to Incest With His Daughter Who Later Died of Suicide

Nationwide — Stephen Vincent Chavez, a 41-year-old dad from Moorpark, California, avoided a state prison sentence after admitting to an incestuous relationship with his biological daughter. The ruling sparked criticism from prosecutors and family members who had pushed for the maximum punishment.

Chavez was sentenced to one year in county jail and three years of felony probation. He pleaded guilty in May to one felony count of incest and one misdemeanor count of providing alcohol to a minor, according to the Ventura County District Attorney’s Office.

According to the New York Post, the case stemmed from events in July 2025 while Chavez’s 18-year-old daughter, Makayla Rene Settles, was staying at his home. Prosecutors said the pair attended a family gathering where alcohol was consumed. After returning home, Chavez purchased additional alcohol for himself and his daughter.

Authorities said Chavez later engaged in sexual intercourse with Makayla. Prosecutors examined whether additional charges, including rape, could be filed, but ultimately determined that incest was the only felony offense supported by the available evidence and applicable law.

Makayla died by suicide in December 2025. During Chavez’s sentencing hearing, several relatives delivered emotional victim impact statements, describing the lasting trauma caused by the incident and the devastating loss of Makayla. Family members urged the court to impose a harsher sentence.

Deputy District Attorney Tessa McCarty argued that Chavez abused his role as a parent and violated his daughter’s trust. Prosecutors sought a three-year state prison sentence, saying his actions permanently altered the course of Makayla’s life.

However, the court imposed a lighter punishment after Chavez entered an open plea agreement directly before Ventura County Superior Court Judge Dusty Kawai. Under California law, felony incest carries a maximum sentence of three years. Kawai said he could not legally impose the maximum term because Chavez had no prior criminal record.

The sentence sparked backlash from prosecutors, who maintained that prison time was warranted based on the facts of the case. While acknowledging the court’s decision, they said they continue to believe a state prison sentence would have been the appropriate outcome.
