Man Pardoned by Former President Biden Charged 1 Year Later for the Same Crime

Nationwide — Oscar Freemond Fowler, a convicted felon released after President Biden commuted his federal prison sentence, was arrested again less than a week later on state charges for the same crimes. One year later, he has been charged again. His brief freedom ended quickly as Florida authorities moved to hold him accountable under local law.

Fowler, 50, had originally been sentenced to more than 12 years in federal prison after pleading guilty to possessing a firearm and ammunition as a convicted felon and for cocaine distribution. He was among nearly 2,500 individuals whose sentences were commuted during Biden’s final days in office, according to CNN.

Just days after his February release, Fowler was back in custody. Florida officials pointed to his history of drug and gun offenses, which remained subject to state prosecution. Legal experts note that federal pardons or commutations do not protect someone from state charges.

“It’s completely plausible to be arrested for the same underlying acts on the state level as on the federal,” said Bernadette Meyler, a Stanford law professor. The Supreme Court’s 2019 Gamble v. United States ruling supports this approach through the dual-sovereignty doctrine, allowing separate state and federal prosecutions for the same acts.

Florida Attorney General James Uthmeier described Fowler as a “dangerous repeat offender” with a criminal record dating back to 1991, including traffic violations, assaults, and drug crimes. Bodycam footage shows Fowler in handcuffs, protesting the charges: “I just got out of prison.”

Experts add that while a commutation reduces a sentence, it does not erase a conviction, leaving state authorities free to pursue legal action. Fowler’s case highlights how federal clemency does not shield individuals from state-level accountability.
